By downloading, installing, or using any application or service ("Services") provided by Brainservice Incorporated ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.
These Terms of Service apply to all applications and services published by Brainservice Incorporated, including but not limited to mobile applications available on the Apple App Store and Google Play Store.
You must be at least 13 years of age to create an account or use our Services. Some Services may be intended for children and are governed by additional policies as described in our Privacy Policy. By using our Services, you represent that you meet the applicable age requirements.
Some Services may allow you to use the app as a guest or create an account using third-party sign-in providers such as Google or Apple. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
Where available, guest accounts provide limited functionality. Data associated with a guest account may not be recoverable if the app is uninstalled or the device is lost. You may upgrade a guest account to a full account at any time where this option is available.
You may delete your account at any time through the app or by submitting a request through our website. We reserve the right to suspend or terminate accounts that violate these terms.
Some Services may offer premium features through paid subscriptions or one-time purchases. All purchases are processed through the Apple App Store or Google Play Store and are subject to the respective store's terms and conditions.
Prices are displayed in the app prior to purchase. We reserve the right to change pricing at any time, though changes will not affect active subscriptions until renewal.
Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies. We do not process refunds directly.
You retain ownership of any content you create within the Services. You grant us a limited license to store, process, and display this content solely to provide the Services to you.
Some Services may allow you to share content or interact with other users. When you share content, certain information (such as your display name, username, and profile picture) may be visible to other users. You are responsible for the content you share with others.

We do not guarantee the accuracy, completeness, or timeliness of any information. To the fullest extent permitted by law, Brainservice Incorporated shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services. This includes, but is not limited to, loss of data, loss of profits, or damages resulting from reliance on information provided by the Services.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We may update these Terms of Service from time to time. Changes will be reflected on this page with an updated date. Continued use of the Services after changes are posted constitutes acceptance of the revised terms.
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
